These Terms of Service ("Terms") govern your access to and use of the Storm Scout mobile application, websites, and related services (collectively, the "Service"). The Service is provided by Storm Scout ("Company," "we," "us," or "our"). By creating an account, downloading, installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and Authority
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you use the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms, and "you" includes that organization.
2. Accounts and Security

You agree to provide accurate account information and keep it up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You will promptly notify us of any unauthorized use of your account or security incident.
3. License and Restrictions
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service for your internal business purposes or personal use, as applicable.
You may not:

Reverse engineer, decompile, or attempt to derive the source code of the Service, except to the extent permitted by law.

Copy, modify, distribute, sell, lease, or sublicense the Service, except as expressly allowed by these Terms.

Circumvent or disable security or access control mechanisms.

Use the Service to develop a competing product or service.
4. Acceptable Use
You agree not to:

Use the Service for unlawful, harmful, fraudulent, or deceptive activities.

Interfere with or disrupt the integrity or performance of the Service or related systems.

Upload or transmit malware, exploits, or other harmful code.

Access or attempt to access data or accounts you are not authorized to access.

Violate the privacy, publicity, intellectual property, or other rights of others.
5. Location Tracking and Shift Controls
Certain features require location services, including precise location and potentially background location while a shift or tracking session is active (depending on your device settings and permissions). Tracking is user-controlled. You can start and stop tracking through in-app controls and can change location permissions through your device settings. If you deny or limit location permissions, some features may not function as intended.
6. Photos, Media, and Voice Input

Media: The Service may allow you to capture and upload photos or videos. You are responsible for ensuring you have rights and permissions to capture and upload such content.

Voice input: The Service may allow voice input via speech-to-text. When you use voice input, your device may request microphone access and audio may be processed to generate text.
7. Device Authentication (Biometrics)
If supported by your device, you may enable device-based biometric authentication (such as Face ID or Touch ID) as a convenience security feature. We do not receive or store your biometric template; biometric data is managed by your device and operating system. We may receive an authentication success or failure result.
8. User Content
"User Content" includes content you submit or make available through the Service, such as photos, videos, notes, forms, and associated metadata. You retain ownership of your User Content.
You grant Company a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your User Content solely to provide, maintain, and improve the Service, comply with law, and enforce these Terms.
You represent and warrant that you have all rights necessary to provide User Content and that your User Content does not violate law or third-party rights.
9. Intellectual Property
The Service, including its software, design, text, graphics, logos, and other content (excluding User Content), is owned by Company or its licensors and is protected by intellectual property laws. Except for the limited license granted in these Terms, no rights are granted to you.
10. Third-Party Services
The Service may integrate with third-party services (for example, authentication providers, mapping services, or device APIs). Third-party services are governed by their own terms and policies. Company is not responsible for third-party services.
11. Fees and Subscriptions (If Applicable)
Some features may require payment. If you purchase a subscription or paid feature, you agree to pay the fees and applicable taxes presented to you. Subscription terms (including billing cycle and renewal) will be disclosed at purchase. If you purchase through a mobile app store, billing and refunds are handled by that store’s policies.
12. Communications
We may send you service-related communications, including security notices, administrative messages, and updates. You may opt out of promotional communications where legally required, but you may still receive essential service messages.
13. Suspension and Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, create risk for other users, or if required by law. Upon termination, your license to use the Service ends.
14. Account Deletion
You may initiate account deletion within the app (if available) or by contacting support. When you delete your account, we will remove your access and will delete or de-identify associated personal information as described in the Privacy Policy, subject to legal and operational retention requirements.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
IN NO EVENT WILL COMPANY’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO COMPANY FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS (US $100), WHICHEVER IS GREATER, UNLESS REQUIRED OTHERWISE BY LAW.
17. Indemnification
You agree to defend, indemnify, and hold harmless Company and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or applicable law.
18. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, excluding conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to personal jurisdiction in those courts.
19. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use of the Service after the effective date of updated Terms constitutes acceptance.
